1. Acceptance of Terms
By creating an account on LoadLeader ("the Platform"), accessing our website at loadleaderservice.com, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you and LoadLeader ("Company," "we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
2. Description of Services
LoadLeader is an online marketplace and load board platform that connects:
- Pilot Car Drivers — certified escort vehicle operators seeking work accompanying oversize loads
- Carriers & Haulers — companies and individuals transporting oversize, overweight, or wide loads who require pilot car escorts
LoadLeader provides tools including load posting, job applications, profile management, AI-powered search, and communication facilitation. LoadLeader is a technology platform only and is not a party to any agreement between pilots and carriers.
What We Are Not
LoadLeader does not employ pilot car drivers, does not own or operate any vehicles, does not provide escort services, and does not guarantee any specific outcome from use of the Platform. We are a neutral marketplace facilitating connections between independent parties.
3. User Accounts
Eligibility
You must be at least 18 years of age to create an account. By registering, you represent that all information you provide is accurate, current, and complete.
Account Security
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify LoadLeader immediately of any unauthorized use of your account. LoadLeader is not liable for any loss resulting from unauthorized account access.
One Account Per User
Each person or business entity may maintain only one account. Creating multiple accounts to circumvent suspensions or restrictions is prohibited.
Account Verification
LoadLeader may require identity verification, license verification, or insurance documentation at any time. Failure to provide requested documentation may result in account suspension.
4. Pilot Car Drivers
Licensing & Certification Requirements
By registering as a pilot car driver, you represent and warrant that you:
- Hold a valid driver's license appropriate for your jurisdiction
- Possess all required pilot car certifications for the states in which you operate
- Carry adequate liability insurance as required by applicable law
- Operate a vehicle that meets all state and federal requirements for pilot car escort vehicles
- Are familiar with and comply with all applicable oversize load escort regulations
Independent Contractor Status
Pilot car drivers using LoadLeader are independent contractors, not employees, agents, or partners of LoadLeader. You are solely responsible for your own taxes, insurance, equipment, and compliance with applicable laws.
Job Acceptance
By accepting a load assignment, you enter into a direct agreement with the carrier. LoadLeader is not a party to this agreement. Any disputes regarding payment, job conditions, or performance are between you and the carrier.
5. Carriers & Haulers
Load Posting Requirements
Carriers agree to post only accurate load information including correct dimensions, weight, route, dates, and compensation. Deliberately misleading load postings may result in account termination.
Payment Obligations
Carriers are responsible for paying pilot car drivers the agreed compensation in a timely manner. LoadLeader is not responsible for payment disputes between carriers and pilots.
Permit Compliance
Carriers are solely responsible for obtaining all required state and federal permits for oversize/overweight loads. LoadLeader does not provide permitting services and is not liable for permit violations.
Insurance Requirements
Carriers must maintain adequate cargo insurance and commercial liability insurance as required by law. Proof of insurance may be required upon request.
6. Payments & Subscriptions
Subscription Plans
LoadLeader offers subscription plans for pilot car drivers and carriers as described on our Pricing page. Subscriptions are billed in advance on a monthly or annual basis.
Free Trial
Carrier accounts receive a 30-day free trial. No credit card is required for the trial period. After 30 days, continued access requires a paid subscription.
Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.
Refunds
LoadLeader offers a 7-day money-back guarantee on all paid subscriptions. To request a refund within 7 days of initial payment, contact support@loadleaderservice.com. After 7 days, payments are non-refundable except where required by law.
Price Changes
LoadLeader reserves the right to modify subscription pricing with 30 days notice. Existing subscribers will be notified by email before any price change takes effect.
7. User Conduct
You agree not to use the Platform to:
- Post false, misleading, or fraudulent information
- Harass, threaten, or abuse other users
- Solicit users to conduct transactions outside of LoadLeader to avoid fees
- Use automated tools to scrape, crawl, or harvest Platform data
- Impersonate another person or entity
- Violate any applicable local, state, federal, or international law
- Post loads that are illegal to transport
- Circumvent any Platform security measures
Violations may result in immediate account suspension or termination without refund.
8. User Content
By posting content on LoadLeader (including load descriptions, profile information, reviews, and messages), you grant LoadLeader a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with providing the Platform services.
You are solely responsible for the accuracy and legality of content you post. LoadLeader reserves the right to remove any content that violates these Terms or that we deem inappropriate.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOADLEADER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
LoadLeader does not guarantee the accuracy of load information, the qualifications of pilots, the reliability of carriers, or any specific outcome from use of the Platform.
Our total liability to you for any claim arising from these Terms or use of the Platform shall not exceed the amount you paid to LoadLeader in the 12 months preceding the claim.
No Warranty
The Platform is provided "as is" without warranty of any kind. LoadLeader does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
10. Dispute Resolution
Between Users
Disputes between pilots and carriers are solely between those parties. LoadLeader may, at its discretion, provide a reporting mechanism but is under no obligation to mediate or resolve disputes between users.
With LoadLeader
Any dispute with LoadLeader shall first be addressed through good-faith negotiation by contacting support@loadleaderservice.com. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association.
Governing Law
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.
11. Termination
LoadLeader may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct harmful to other users or the Platform.
You may delete your account at any time from your account settings. Upon termination, your right to use the Platform ceases immediately. LoadLeader may retain certain data as required by law or for legitimate business purposes.
